Prohibited Items Policy

For the most part, BloomNation partners are selling beautiful fresh flowers and plants, however, there are times when you may want to add a little something extra to your listing or offer an array of cross-sell items to supplement your catalog (which is a great idea!).

While we’re all about artistic freedom here at BloomNation we also want to make sure every customer and partner feels safe and protected. This means that there are some goods or services which are not permitted to be listed for sale, linked to directly or indirectly, referenced, or described under any circumstances.

When reading through the following rules, please remember that although some items may leave room for historical or contextual interpretation, we reserve the right (but are not obligated) to pre-screen, review, flag, filter, modify, refuse or remove any item we feel is inappropriate without warning or explanation. Please report any items you feel violate these rules here. To report copyright or intellectual property infringement, please follow the instructions in BloomNation’s Copyright and Intellectual Property Policy .

Please Note: We will never tell you how to run your own website but, we highly recommend you follow these rules when posting items for sale on your Premium Site as well.

Content that is prohibited on the BloomNation Marketplace:

Images That Violate Our Photography Guidelines

The pictures of the items you are listing for sale are just as important as the items you are selling. Be sure that you do not use an image that:

• Violates our Product Photography Guidelines
• Includes content that violates the rules below
• You don’t have full rights to including stock photography and images that violate our copyright and intellectual property policy.

Alcohol, Tobacco, Drugs and Drug Paraphernalia

You may not include the following in any of your marketplace offerings:

• Alcohol
• Tobacco products, smokeable products, e-cigarettes, and e-liquid.
• Drugs including any substance used for recreational and/or medicinal purposes.

Hazardous or Dangerous Materials

You may not include items that present an unreasonable risk of harm in any of your marketplace offerings:

• Explosives (fireworks, poppers, sparklers, etc)
• Toxic Substances
• Weapons (non-culinary knives, guns, anything else intended to be used to inflict harm on a person).
• Items that have been identified by the U.S. Consumer Products Safety Commission as hazardous to consumers and, therefore, subject to a recall.

Animals and Certain Animal Products

You may not include the following in any of your Marketplace listings:

• Live animals
• Items derived from or created using any animal species designated as threatened or endangered under the US Endangered Species Act
• Items made from cats or dogs as defined by US Federal Law.
• Items made from ivory or bones from ivory-producing animals.
• Items made from or incorporating human remains.
• Items containing illegally obtained animal parts including bird feathers, talons, skin, etc.

Items that Identify a Specific Customer

You may not include the following in any of your Marketplace listings:

• Items that include images or description of a specific person (included the deceased), their personal or payment information

Illegal Items, Services, or Items that Promote Illegal Activity

You may not include the following in any of your Marketplace listings:

• Illegal, counterfeit, or stolen items.
• Infringe upon any third-party’s copyright, patent, trademark, trade secret or other proprietary or intellectual property rights or rights of publicity or privacy (see our Copyright Policy ).
• Items that violate local, state, or national law (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising)

Obscene, Pornographic, Violent or Hate Items or Items that Support or Promote Violence or Hate

BloomNation is all about bringing beauty, comfort, and celebration into people’s lives. To that end, you may not include items, images, or writings that:

• Promote or support demeaning or discriminating against a certain group or type of people.
• Are defamatory, libelous, impersonate or intimidate any person (including our staff or other users)
• Falsely state or otherwise misrepresent your affiliation with any person or group (for example, using a logo or image on behalf of a charity without that entity’s express consent).
• Use obscene language, gestures, symbols, or are pornographic in any way.
• Are used to inflict harm, incite violence or glorify violent acts towards self or others.
